Nov. 26, 2015 - A Michigan jury convicted former Inkster cop William Melendez of misconduct in office and assault with intent to do great bodily harm less than murder. Patrol dash cam footage showed Melendez repeatedly punching unarmed motorist Floyd Dent during a traffic stop in January. Melendez will be sentenced on December 3. Lee and Chris Seaton sit down to discuss the case.

Sept. 15, 2015 (Mimesis Law) — In February of 2014, the Bastrop County Sheriff’s Office answered a disturbance call at Yvette Smith’s home. Within hours, Yvette was dead, shot twice by a deputy sheriff’s rifle as she opened her door. Yvette was African-American and the deputy, Daniel Willis is white.

Sept. 14, 2015 (Mimesis Law) — Late last week, Shire Plc (SHPG) and Celgene Corporation (CELG) both filed responses to a request by the Patent Trial and Appeal Board (PTAB) for additional briefing regarding the propriety of IPR petitions filed by Kyle Bass.  Both Shire and Celgene have asked for sanctions, stating that Bass is improperly using the IPR petitions to manipulate stock prices.

Aug. 18, 2015 (Mimesis Law) — RPX has built a reputation for taking varied approaches towards solving the “patent troll” problem on behalf of its clients/members. One approach that RPX takes is to identify “dangerous” patents, buy them, and kill them. But that is not the only way to kill a patent, especially in today’s Age of the IPR. In an interesting development, RPX filed three IPRs attacking two patents currently being asserted against Salesforce in a pending Nevada patent infringement action. The Plaintiff in the District Court case is an entity with a retro website called Applications in Internet Time LLC and the case has been pending since 2013.

Aug. 17, 2015 (Mimesis Law) — At the end of July, syndicated cartoonist Ted Rall was fired by the Los Angeles Times.  During his tenure, he provided snark and insight through the medium of the comic strip and the occasional blog post.  On May 11, Rall wrote a blog post for the LA Times about his less-than-pleasant encounter with Officer Will Durr of the LAPD way back in 2001.

Aug. 12, 2015 (Mimesis Law) — Morgan Geyser and Anissa Weier, the Wisconsin girls accused of stabbing a classmate last year, are a step closer to being tried as adults.

A Wisconsin Circuit Judge Michael Bohren denied both of the girls’ petitions calling for the proceedings to continue in the juvenile justice system. In May 2014, at the age of 12, the girls allegedly lured their friend into the woods before stabbing her more than 19 times with a kitchen knife. Geyser and Weier claimed that they wanted to kill Payton Leutner in obedience to Slenderman, a fictional character from the Creepypasta horror stories.

July 21, 2015 (Mimesis Law) — When “patent trolls” want to blame a corporate bully for any of their travails, Google is often among the first companies mentioned. There is no doubt that Google has taken an active role in pushing for patent reform, while making technological resources available to all that help demystify the patent system. There is also no doubt that Google is a frequent target of patent infringement lawsuits by non-practicing entities, and is one of the PTAB’s most loyal customers when it comes to use of IPR’s as an offensive tactic to try and upend those lawsuits. At the same time, Google is pretty aggressive in terms of buying and filing patents for its own patent estate.
